("we", "us", or "our").
By accessing, registering for, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. If you are under 18 (or the age of majority in your jurisdiction), you must have permission from a parent or legal guardian, who agrees to these Terms on your behalf. Parents/guardians are responsible for supervising minors' use, especially for events involving children.
2. User Accounts
To access certain features (e.g., registering animals, tracking events), you must create an account with accurate information. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us immediately of any unauthorized use.
3. User Conduct
You agree not to:
- Use the Service for any unlawful, harmful, or abusive purpose;
- Upload content that infringes rights, is obscene, harassing, or promotes illegal activity;
- Impersonate others or provide false information;
- Interfere with the Service (e.g., viruses, spam, excessive requests);
- Exploit the Service for commercial purposes without permission;
- Share or misuse information about children or events without authorization.
We may remove content or terminate access for violations.
4. User Content
You retain ownership of content you upload (e.g., animal photos, names, notes). By uploading, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute it in connection with providing and promoting the Service. You warrant that your content does not infringe third-party rights.
5. Intellectual Property
The Service, including text, graphics, logos, and software, is owned by us or our licensors and protected by copyright, trademark, and other laws. You may not copy, modify, or distribute any part without permission.
6. Payments and Fundraisers (If Applicable)
For paid features, events, or fundraisers, payments are processed by secure third-party providers—we do not store card details. You agree to pay all fees and authorize charges. Prices/taxes may apply. We may cancel or refund transactions at our discretion (e.g., errors, fraud suspicion). No refunds for completed event services unless stated.
7. Events and Fundraisers
We facilitate school Zoo-a-thons, birthday parties, and events but are not responsible for their execution, safety, or outcomes. Schools/organizers are responsible for compliance with laws, permissions, and safety. We do not guarantee fundraising amounts or event success.
8. Disclaimers and Limitation of Liability
The Service is provided "AS IS" without warranties of any kind. We disclaim all warranties (express/implied) including fitness for purpose or non-infringement. To the fullest extent permitted by law, we are not liable for indirect, incidental, consequential, or punitive damages, even if advised of possibility. Our total liability shall not exceed amounts you paid us in the prior 12 months (or $100 if none).
9. Termination
We may suspend or terminate your access at any time for violations, at our discretion, or if required by law—without notice or liability. You may stop using the Service anytime. Upon termination, your account and access end; some provisions (e.g., liability, IP) survive.
10. Changes to Terms
We may update these Terms. Continued use after changes constitutes acceptance. Material changes will include reasonable notice (e.g., via email or site posting).
11. Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in courts located in Taylor County, Texas. You agree to waive jury trial and class actions where permitted.
